I hired a general contractor(Steve Sierleja of Custom Homes Ltd.) to complete a shell for cash on my property. He had as a part of the contract intended to install a 2x6 exterior grade lumber floor on a second story balcony (300 sq. ft) that also had a hardi ceiling underneath. It didn't take him long to realize that having a ceiling beneath a non-waterproof floor was a bad idea. He subsequently offered to install a waterproof floor as a change order for a cost that was never discussed. I couldn't afford this and requested that he simply not install the decking or the ceiling as I would do that later when funding allowed and I would accept a credit for this change. No change order was ever drawn up.
As a result he didnt waterproof the structural components of the home and said that was what I requested. He has since been paid in full and now that the stucco on the columns under the exposed beam are cracking he insists I waterproof the beam before he will repair the stucco.
When I stated I would take my case to the BBB he threatened to sue me for defamation. He also attempted to unilaterally change the scope of his warrantee to cut out the columns since I hadn't waterproofed the beam.
